Legal and Compliance Issues

Franchise sales are tightly regulated by both federal and state regulatory authorities. Please see below a summary of the regulations that ACA must follow:

1. Provide a complete disclosure of all significant details regarding ACA’s sale of franchises to appropriately qualified individuals in ACA’s Franchise Disclosure Document (FDD) and Franchise Agreement (FA).

2. These documents will only be provided to applicants who are qualified to own and operate one of our franchises in states where ACA is registered to operate. Note that ACA does not guarantee the profits or performance of any franchise.

3. If an interested party does not reside in one of the states where ACA is registered to operate, but is interested in owning a franchise, please contact us. ACA can pursue the ability to license franchises in other states, but ACA cannot provide any detailed information about franchise opportunities until registered to operate in a state.

4. ACA is currently able to provide franchise opportunities in Alabama, Alaska, Arizona, Arkansas, Colorado, Delaware, District of Columbia, Idaho, Iowa, Kansas, Massachusetts, Mississippi, Montana, Nevada, New Hampshire, New Jersey, New Mexico, Ohio, Pennsylvania, Tennessee, Vermont, West Virginia, and Wyoming.

5. Specific documents are required for specific states, therefore FDDs and FAs provided to applicants are state specific.

6. Upon approval of an applicant, ACA will provide a copy of the FDD and FA.

7. Applicants must sign a receipt of delivery for these documents.

8. All spouses of applicants or any other partners of the applicant must be provided copies of the FDD and FA separately as well, and must acknowledge receipt of these documents.

9. After receiving the FDD and FA documents, there is a mandatory two (2) week waiting period before any documents can be signed. This waiting period begins after ACA receives the last acknowledgement of delivery from any applicant, spouse, or partner. Discussions regarding these documents with ACA may proceed during this waiting period.

10. Upon acceptance of an agreement, ACA will need to confirm the credentialing information of the applicant and other details, including contact information and specifics regarding any proposed signers of the FA.

11. ACA’s attorney(s) will prepare the final agreement(s) and the ACA franchising process will proceed from there.
